The European legislator now more forcefully mandates in the new paragraph 2 that Member States implement an automatic refund mechanism for the organiser within seven days whenever the service provider cancels or fails to provide a service that forms part of a package. It is worth noting that the organizer acts towards the traveler under the principle of strict liability (Article 13, § 1). Between the organizer and the service providers, we are in the realm of contractual (obligational) liability. The interpretation of the rule can be complex. XII.
