As a conclusion The paper deals with the traveller right’s to terminate the package travel contract before the start of the package in the event of ‘unavoidable and extraordinary circumstances’. The first part of this paper provides a description of the actual regulation on the «Termination of the package travel contract and the right of withdrawal before the start of the package» (Article 12(2) PTD). Then, the paper analyses the proposal for amending the PTD on this topic. The final part of the paper contains some reflection considering the decisions of the Court of Justice of the European Union on the subject, the case law of some national court and the opinion of the scholars. FOREWORD The Article 12(2) of the Directive (EU) 2015/2302 on package travel and linked travel arrangements (‘the Package Travel Directive’, ‘the Directive’ or ‘the PTD’) contemplates for the traveller a specific right to terminate the package travel contract.
