c) providers and deployers of AI systems that have their place of establishment or are located in a third country, where the output produced by the AI system is used in the Union; d) importers and distributors of AI systems; e) product manufacturers placing on the market or putting into service an AI system together with their product and under their own name or trademark; f) authorised representatives of providers, which are not established in the Union; g) affected persons that are located in the Union. The Artificial Intelligence Act imposes different obligations for different categories of agents involved in the production and deployment of Artificial Intelligence systems and applications. Therefore, the type and extent of obligations which apply will depend on the category of operator a person falls into, and the type and purpose of Artificial Intelligence technology being used. III. CONCEPT OF ARTIFICIAL INTELLIGENCE SYSTEM UNDER THE ARTIFICIAL INTELLIGENCE ACT According to article 3(1) of the Artificial Intelligence Act, an “Artificial Intelligence system” is defined as “a machine-based system that is designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment, and that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. This is a broad definition6 that, according to the Artificial Intelligence Act, is based on key characteristics of artificial intelligence systems and takes into consideration their capability to infer and produce different outputs such as predictions, content, recommendations, or decisions, which can influence physical and virtual environments. With the adoption of this definition, it is expected that it will apply to a wide range of artificial intelligence systems and applications, including generative artificial intelligence tools but also more basic systems. 6 Zanol, J., Buchelt, A., Tjoa, S., Kieseberg, P., “What is “AI”? exploring the scope of the “artificial intelligence act”, https://jusletterit.weblaw.ch/dam/publicationsystem_leges/iris2022/zanoal_et_al_what_is_ai.pdf 87 THE IMPACT OF ARTIFICIAL INTELLIGENCE REGULATIONS ON THE TOURISM INDUSTRY
