abusive, and they contradict European Union values of respect for human dignity, freedom, equality, democracy and the rule of law and fundamental rights enshrined in the Charter, including the right to non-discrimination, to data protection and to privacy and the rights of the child. b. High-Risk Artificial Intelligence (HRAI) systems used in the identified list of “high risk” contexts. The use of High-Risk Artificial Intelligence systems is permitted within the European Union but must comply with multiple requirements and undergo a conformity assessment before the system is released on the market. According to article 6(1) an Artificial Intelligence system shall be considered to be high-risk if both of the following conditions are fulfilled: (a) the artificial intelligence system is intended to be used as a safety component of a product, or the artificial intelligence system is itself a product, covered by the Union harmonisation legislation listed in Annex I8; (b) the product whose safety component pursuant to point (a) is the artificial intelligence system, or the artificial intelligence system itself as a product, is required to undergo a third-party conformity assessment, with a view to the placing on the market or the putting into service of that product pursuant to the Union harmonisation legislation listed in Annex I. Furthermore, article 6(2) establishes that also artificial intelligence systems referred to in Annex III shall be considered to be high-risk. Therefore, artificial intelligence systems will be considered “high risk” if listed in any of the following areas: biometrics; critical infrastructure; education and vocational training; employment, workers management and access to self-employment; access to and enjoyment of essential private and public services and benefits; law enforcement; migration, asylum and border control management; administration of justice and democratic processes9. persons or a genuine and present or genuine and foreseeable threat of a terrorist attack; c. the localisation or identification of a person suspected of having committed a criminal offence, for the purpose of conducting a criminal investigation or prosecution or executing a criminal penalty for offences referred to in Annex II and punishable in the Member State concerned by a custodial sentence or a detention order for a maximum period of at least four years. 8 Annex I.
