Gastronomy Law

III. IMPLICATIONS FOR FOOD LAW The objectives outlined above have significant implications for food law in Europe. They drive the development of detailed regulations and standards that food businesses must adhere to, affecting everything from production processes to marketing strategies. Compliance with these regulations is crucial for businesses to operate legally within the EU market and to maintain consumer trust. The setting up of the independent Authority is to be accompanied by a wide range of other measures to improve and bring coherence to the corpus of legislation covering all aspects of food products from “farm to table”. Already the Commission has identified a wide range of measures that are necessary to improve food safety standards. The White Paper9 sets out over 80 separate actions that are envisaged over the next few years. Moreover, the focus on consumer protection and public health necessitates10 continuous updates and adaptations to food laws as new risks and scientific knowledge emerge. The drive for transparency and fair trade practices ensures that businesses operate ethically and that consumers have access to accurate information about their food. In summary, the objectives of European food regulation shape a robust legal framework that aims to safeguard consumers, promote fair practices, and support sustainable food systems. These regulations play a crucial role in maintaining high standards of food safety and quality across Europe. In October 2021, the European Union (EU) had several ongoing and upcoming legislative initiatives related to food and agriculture that were expected to continue through 2025. Some key areas of focus in EU food legislation that were relevant as of my last update: 1. Farm to Fork Strategy11: This initiative aims to make the EU’s food system fair, healthy, and environmentally friendly. The strategy encom9 Following the Commission’s Green Paper on food law (COM(97)176 final), and subsequent consultations, a new legal framework will be proposed. 10 The implementation of all the measures proposed in the White Paper will enable Food Safety to be organised in a more co-ordinated and integrated manner with a view to achieving the highest possible level of health protection. Legislation will be reviewed and amended as necessary in order to make it more coherent, comprehensive and up-todate. Enforcement of this legislation at all levels will be promoted. The Commission believes that the establishment of a new Authority, which will become the scientific point of reference for the whole Union, will contribute to a high level of consumer health protection, and consequently will help to restore and maintain consumer confidence. 11 https://food.ec.europa.eu/document/download/472acca8-7f7b-4171-98b0-ed76720d68d3_en?filename=f2f_ action-plan_2020_strategy-info_en.pdf 146 ANA BRANCA SOEIRO DE CARVALHO | SUSANA MSR FONSECA | ANA GUIA | CARLOS LOPES
