law, as a mechanism that requires economic agents to adopt behaviors consistent with the preservation of the open market, which goes beyond mere direct competitive relations. We also concluded that the concept of unfair competition, as provided for in the CPI, is still not the ideal means of protecting economic agents in situations of unfair classification of commercial establishments on digital platforms based on comments left by users of those platforms, since we are not dealing with behavior between competitors. We therefore believe that the regime provided for is not sufficiently effective, especially for micro, small, and medium-sized enterprises potentially harmed by the intentional or negligent failure of these digital platforms to implement transparent, equitable, and non-discriminatory conditions in the construction of ratings of commercial establishments based on user comments. In fact, in addition to the possibility of complaining to the platform itself, recourse to the courts or the European Commission itself is too time-consuming for the practical needs of these companies. The strengthening of effective means of protection that can be used in these circumstances, which are potentially extremely damaging to micro, small, and medium-sized enterprises that own commercial establishments, is a matter that will certainly warrant further study in the future.
