Beyond its definition, legal nature and the consequences of breach of contract, the concept of the restaurant catering service contract, also important for the research, is examined in the framework of tourism law, to show in particular its contractual elements compared with related issues arising in other tourism contracts (see chapters 6, 7, 8 and the footnote text, passim). The scope of the paper is to reduce the complexity of its legal character and definition, and to investigate the applicable law of the (restaurant) catering contract and last but not least to contribute, in any small way, towards the regulation of this kind of contract used in daily practice, which plays a major role in organising tourism and developing the national economy. INTRODUCTION Beyond the extensive codification of the various types of specific contractual obligations such as sale1, donation2, lease3, contracts for work4, mandate5, brokerage contract6, loan for use (commodatum)7, deposit8 etc., called nominate contracts, modern transactions of daily practice have brought to light many ‘atypical’ types of contracts9, the so-called innominate contracts10.
