is shaped by the limitations of public order and special health regulations (see chapter 6). The catering contract (and especially the restaurant catering service contract) may constitute part of a hospitality contract or organized travel contract, as it may be autonomous or in the form of a catering services provision (see the footnote text, passim)19. II. MOTIVATION The importance of research in law lies in the ambiguity in the practice of applying legislation to regulate legal relations in the catering services contract. This uncertainty leads to problems in resolving disputes that arise between the contract parties (restaurateurs and customers), especially problems in choosing the contractual structure (obligation and rights) that should be used irrespective of to whether the parties agree on individual contract conditions or on general contract terms20. This study focuses on addressing the restaurant services contract in general and the obligations incumbent on the restaurant owner in particular. Further, as far as concerns tourism law, the importance of the research lies in the increasing attention given to the (restaurant) catering service contract in particular among those more prominent tourism contracts, such as the 19 Compare in German-language legal orders (as the German, Austrian and Swiss one) the so called “Bewirtungsvertrag“ alias „Vertrag mit Restaurantleistungen“, especially in the context of a „Beherbergungsvertrag“ or otherwise of a „Gastaufnahmevertrag“, Amstutz & Morin, supra n. 9, Rn. 292-313 (with further references); Claire Huguenin & Arnold F. Aufl., 2024, § 49 Bewirtungsrecht, Rn. 1, 2, 3, 9. 20 As is accepted for General Terms and Conditions (GTC) in general, in (restaurant) catering contracts the general terms and conditions must be explicit and transparent too, accepted upon conclusion of the contract to be valid. This can be done, for example, by displaying the text in the business premises, by explicit reference, or by signing the GTC documents.
