of the Ecuadorian State and the European Union (EU), highlighting differences and similarities that aim to improve Peruvian regulations. The importance of TSGs as strategic tools should also be noted to contribute to medium and small tourism companies in the local or regional markets in which they compete, in order to promote the integration of gastronomy (culinary tradition), crafts, folklore and other cultural and traditional activities. II. BACKGROUND OF THE ETG, LEGAL AND PROCEDURAL EVALUATION IN THE CASE OF PERU TSGs in European countries have a long history dating back to the last century. Thus, in the times of the European Community, TSGs were initially regulated by Council Regulation (EEC) No. 2082/92 (14 July 1992), for the certification of the specific characteristics of agricultural and food products, which consisted of specific rules for the protection, authenticity and quality of these products. Later, Regulation (EU) No. 1151/2012 of the European Parliament and of the Council (21 November 2012) was issued by the European Union, regulating the quality regimes for agricultural and food products. It is known that the first TSG registered It was Roquefort cheese in France in 1996, followed by Parma ham in Italy in 1998 (L&C Communication, 2023) With regard to the current regulation governing TSGs in the EU, it is Regulation (EU) 2024/1143 of the European Parliament and of the Council (hereinafter Regulation (EU) 2024/1143), which comprehensively repeals Regulations (EU) No. 1308/2013, (EU) 2019/787 and (EU) 2019/1753 , and similarly repeals Regulation (EU) No. 1151/2012. Currently, there are a variety of products protected under the figure of Traditional Specialities Guaranteed, which are numbered in more than 1,400 products throughout the EU (L&C Communication, 2023), although Regulation (EU) 2024/1143 establishes in recital 64 that their full potential has not been developed. In Latin America and specifically in the Andean Subregion, Ecuador was the first to include ETGs in its industrial property regulations, following the promulgation of the Organic Code of the Social Economy of Knowledge, Creativity and Innovation Official Registry No. 899 (hereinafter COESCCI); it was subsequently partially regulated in the Knowledge Management Regulations, approved by Agreement No. SENESCYT-2020-077 of December 22, 2020 (hereinafter Agreement No. SENESCYT-2020-077 ). 732 CARLOS EDUARDO ARMAS MORALES
