Upscale Establishments The court explicitly noted that in an upscale restaurant (Lokalen der gehobenen Kategorie), the customer pays for more than sustenance. They are purchasing the “relaxing enjoyment in a pleasant atmosphere” (erholsamen Genuß in angenehmer Umgebung).
