V. CONCLUSION The Artificial Intelligence Act implements a risk-based approach, since it distinguishes between prohibited artificial intelligence systems, high risk artificial intelligence systems and low or minimal risk artificial intelligence systems. Many artificial intelligence systems and applications that are currently being used will fall under the high or minimal risk category, and they will be allowed if they comply with the provisions of the Artificial Intelligence Act. Furthermore, the Artificial Intelligence Act implements a guidance, supervision and enforcement framework. It also sets out penalties to be imposed following non-compliance with the Act. However, many of the challenges related to the use of artificial intelligence systems and applications in the tourism industry still persist. Therefore, other relevant sectoral legislation such as the General Data Protection Regulation (GDPR), antidiscrimination law, consumer protection legislation, product safety and also liability for defective products may apply. 94 PAULA CASADESUS RIPOLL
