ambience. The chef has an interest in ensuring that other restaurants do not use signage that could cause misunderstanding or confusion and mislead. Like any business owner, the restaurateur may have recourse to discipline to protect the business and the sign; thus, in the case of the same or similar signs, the judge may order modifications or suppressions. There must be a likelihood of confusion due to the object of the business and the place where it is carried on33. For the best known and most globally accredited restaurants, the scope of protection may be international. VI. THE RECENT LEGISLATIVE DECREE NO. 219 OF 2024 ON THE PROTECTION AND ENHANCEMENT OF HISTORIC PLACES OF COMMERCE AND CRAFT WORKSHOPS OF PARTICULAR HISTORICAL, CULTURAL AND COMMERCIAL SIGNIFICANCE For the purposes of the protection and enhancement of historical places of commerce and craft workshops, with historical, cultural and commercial relevance, Legislative Decree No. 219 of 2024 established special registers at local level and one at national level. In particular, according to Article 3, the former can be created by municipalities, regions, metropolitan cities and provinces. Pursuant to the same Article 3, activities that have existed for at least fifty years and are characterised by a commercial, cultural, historical, artistic or tourist interest or by a link with local traditions are historical. Article 4 creates a further category of historical activities of excellence and identifies them as those that have been carried out for at least seventy years on the same premises, have as their object production, catering or retailing, have been managed by at least three consecutive generations of the same family, have maintained the quality of the service, are of historical, cultural, artistic, tourist or merchandising interest, and have preserved their original appearance, interiors and furnishings. According to Article 6, the national register includes those of the regions, metropolitan cities, municipalities and autonomous provinces and includes a specific section dedicated to historical initiatives of excellence. In the event of a take - over by another entrepreneur, the establishments may continue to be qualified as historic provided that the take - over ensures continuity of action with the same sales or production methods.
