The constitutional regulations, tourism, gastronomy and heritage regulations were reviewed, with the aim of relating them to the regulatory regulations that govern the ETG, which is summarized in Table 2. The first rule that was revised was the Peruvian Political Constitution, which provides in Article 192 that regional governments promote tourism and therefore gastronomic tourism, as indicated in the constitutional legal framework, which enables localities and regions to act and promote gastronomy and tourism in their places. From the heritage area, the General Law of the Heritage of the Nation, updated by Law 31770, which modifies the General Law of the Heritage of the Nation, establishes as cultural heritage of the nation any material or immaterial manifestation related to or with an impact on human activity; in the same way, traditional immaterial manifestations of culinary practices are supported by the variety of natural resources and their ancestral traditions and knowledge, which are techniques transmitted from generation to generation, 5constituting special attractions of the peoples (Law 31770, 2023, Article II of the TP, numeral 2.1 of Article 1). In this regard, there are various studies that indicate that Peru has a Food Heritage at a global level undoubtedly related to Peruvian cuisine and gastronomy (Guardia, 2020; Matta , 2012); moreover , years ago Peruvian cuisine and gastronomy aimed to be considered cultural heritage of the nation, an aspiration that was achieved with the issuance of Resolution No. 1362/INC of October 16, 2007. The General Tourism Law (Law No. 29408) of September 16, 2009, in its articles 3.10 and 3.11 respectively, specifies two principles of tourism activity, indicating that this activity strengthens the principle of identity and integration , since it promotes national identity and integration through the rescue and promotion of intangible heritage (food products) benefiting local populations. It also adds the principle of conservation of tourism activity that supports the rescue and revaluation of ancestral culture based on traditional uses and customs, alluding in some way to traditional food preparations. However, the regulations of the General Tourism Law: Supreme Decree No. 003-2010-MINCETUR of January 15, 2010, prescribes that any element related to tourism can be certified or registered, either by MINCETUR or another entity, whether public or private.
